Kurate

Terms of use

In short

  • Kurate never holds your funds: every action is a transaction you sign.
  • Kurate is not available to US persons or residents of excluded countries.
  • Nothing on Kurate is financial, legal or tax advice.
  • Kurate charges 0.1% on each supply, withdrawal, borrow, repayment and swap, shown before you sign.
  • Swaps are routed by LI.FI, Jupiter or liquidity pools on Orca, Meteora and Raydium, third-party services.

01

The service

These terms govern your use of the interface published at kurate.finance and app.kurate.finance (the “Interface”), operated by [Legal entity name] (“Kurate”, “we”). You accept them by signing the sign-up message with your wallet; that signature is recorded with the version of the terms it applies to. The Risk disclosures form part of these terms and are accepted at the same time.

The Interface lets you supply EURC to, and borrow EURC from, lending markets deployed on Kamino Lend on Solana, and post collateral such as tokenised stocks (xStocks). Kurate curates those markets: it chooses the assets listed and sets the risk parameters, which are published and enforced on-chain.

The Interface also gives access to euro lending markets run by others: Kamino Lend markets curated by third parties (such as the Kamino SOL/BTC market and Schuman EURØP Prime) and Jupiter Lend vaults. Kurate lists them but does not set their parameters, which their owners can change at any time; they are marked as listed from their protocol.

Kurate is non-custodial. We never hold, control or have access to your assets or private keys. Every deposit, withdrawal, borrow, repayment and swap is a transaction you sign yourself; once confirmed, we cannot reverse, cancel or recover it. The markets run on smart contracts written and operated by Kamino, a third party Kurate does not control.

02

Eligibility and excluded countries

You may use the Interface only if you are at least 18 years old with full legal capacity, and only where doing so is lawful. It is not offered to anyone in the following cases:

  • US persons, as defined in Regulation S under the US Securities Act of 1933, and anyone located, resident or incorporated in the United States.
  • Anyone located or resident in Cuba, Iran, North Korea, Syria, Russia, Belarus, or the Crimea, Donetsk and Luhansk regions of Ukraine. [Additional excluded jurisdictions to confirm.]
  • Anyone listed on, owned or controlled by, or acting for someone listed on a sanctions list maintained by the United Nations, the European Union, the United Kingdom or the US Office of Foreign Assets Control.
  • Anyone using a VPN or any other means to get around these restrictions.

US persons are excluded. Tokenised stocks in particular are never offered to US persons. Access may be blocked by location, and we may refuse or end access if we reasonably believe you do not meet these conditions.

03

No investment advice

Nothing on the Interface, on this website, in the journal or in our communications is investment, financial, legal or tax advice, nor a recommendation to buy, sell, lend or borrow any asset. Rates, figures and examples are information only.

You decide alone whether a transaction suits you. Seek independent advice if you are unsure.

04

Swaps through LI.FI, Jupiter and liquidity pools

Some flows let you exchange one token for another before or after using a market. Those swaps are routed by LI.FI or Jupiter, third-party aggregators that pick the route across decentralised exchanges, or go directly through liquidity pools on Orca, Meteora and Raydium, third-party protocols; the Interface compares their quotes and lets you choose. Kurate does not execute or guarantee them, and each aggregator’s or protocol’s own terms apply to the swaps it carries.

Kurate charges 0.1% on each swap, whatever the route, shown in the quote before you sign. LI.FI and the pools may charge their own fee on top, also shown in the quote. When a swap goes through a Meteora pool, Meteora pays Kurate a share of its own protocol fee; this does not change what you pay.

The quote shown is an estimate. The amount received can differ within the slippage tolerance you set, and a swap can fail and still cost network fees.

05

Your responsibilities

You are solely responsible for your wallet, your seed phrase and the devices you use: anyone who controls your wallet controls your positions, and we cannot restore access to one. Check every transaction before you sign it.

  • Comply with the laws that apply to you, including tax law.
  • Do not use the Interface to launder money, finance terrorism, evade sanctions or commit fraud.
  • Do not manipulate a market or an oracle, or attack, overload or probe the Interface or the contracts behind it outside a responsible disclosure.

The markets take a share of the interest paid by borrowers, as set in their on-chain parameters. Network fees are paid to the Solana network, not to Kurate.

Kurate fee. Kurate charges a fee of 0.1% of the amount of each supply, withdrawal, borrow and repayment made through the Interface, in any market, and of each swap. It is paid to Kurate’s fee wallet within the same transaction: in the token of the transaction for lending actions and pool swaps, through the aggregator’s integrator fee for swaps routed by LI.FI or Jupiter. If the transaction fails, no fee is paid. The fee is shown before you sign, and it adds to the fees of the protocols and of the Solana network. We may change it for future transactions by updating these terms.

06

Limitation of liability

The Interface is provided “as is” and “as available”. We may change, suspend or stop it at any time. Because the markets live on-chain, your positions remain reachable through Kamino or any compatible interface if ours is unavailable.

To the extent the law allows, Kurate is not liable for losses arising from the smart contracts, oracles or protocols the markets rely on; the Solana network; LI.FI or any exchange it routes to; the issuers of EURC, xStocks or other listed assets; the liquidation of a position; your wallet or devices; or market movements.

Where our liability cannot be excluded, it is limited to direct and foreseeable damage. Nothing in these terms limits liability for gross negligence, wilful misconduct, or anything else that cannot be limited under the law that applies to you, including mandatory consumer protection rules.

07

Changes, law and disputes

We may update these terms. A new version carries a new date, and you will be asked to sign it before continuing to use the Interface.

These terms are governed by [applicable law]. Disputes go before the courts of [jurisdiction], without prejudice to any mandatory rule allowing a consumer to bring proceedings where they live. Before going to court, write to paulunemoon@gmail.com so we can try to settle the matter amicably.
